FAQ

Are there other things I should consider?

Yes. Make sure to check your local laws about what type of projects you can do and what conditions you have to comply with. You may need to obtain approval from the local council before you can build in some states. Others say you just need to inform them of your plans. Find out the position of your local authorities on this matter by checking with them.

Where can I find more information about building permits?

You can contact your local government authority, such as the NSW Local Government Association, or your local realty agent. They should be able to advise you about what steps you need to take to obtain permission to build.

Do I require a legal representative in order to sign my Service Agreements

No. Your service agreements can be signed by anyone. A legal representative may be necessary to sign your service agreements.

People who act for another person are called legal representatives. If you are a contractor, you may want to appoint someone who will represent you professionally.

This could be hiring an accountant or solicitor. It could also be the appointment of someone to look out for your business interests.

In most cases, a legal representative is appointed by the client. But sometimes, a legal representative is hired by the vendor.

In both cases, having a lawyer means that you are legally covered.

How To

What is the difference between service agreements and contracts?

A service arrangement is an agreement whereby a provider agrees with a customer to perform services. It creates an obligation between the parties. The term "service" is used to describe a company's products and advice. Financial services are not included.

A contract is an legally binding document that describes the terms and circumstances of a business relationship. You can purchase a product at a retailer and a contract will be created. The reason you are required to pay later is because of the obligation you have to buy it. When you accept employment, you are entering into a contract.

The service agreement does not require any documentation. In practice, a written service agreement is seldom used. Verbal agreements will be accepted as the standard.

However, a service contract has many benefits over a contractual agreement:

  1. A service agreement is more flexible than a contract.
  2. It allows service providers to change their minds without any penalty.
  3. This gives the service more flexibility when it comes to delivering the service.
  4. It is a record of the promises made.
  5. It is much easier to make a complaint against a service provider.
  6. It is much cheaper to write a service contract than a standard contract.
  7. It is less likely to lead to litigation.
  8. It is more simple to terminate an agreement for service than a contract.
  9. It is simpler to modify a Service Agreement than a Conventional Contract.
  10. You can set up an ongoing relationship by using a service arrangement.
  11. It is possible to divide the cost of drafting service agreements with third parties.
  12. Including a provision requiring arbitration when drafting a service agreement is possible.
  13. It is possible for provisions to be added regarding confidentiality, proprietary rights, non-disclosure etc.
  14. It is possible for the contract to be specified in terms of its duration (e.g. 1 year).
  15. It is possible to subject the service agreement to a condition precedent.
  16. It is possible to state that the service provider will be liable only for negligence, gross negligence, willful misconduct, or fraud.
  17. It is possible, however, to limit liability for consequential losses.
  18. It is possible for a service provider to enter into a new agreement with a customer.
  19. You can give notice of termination in certain circumstances.
  20. It is possible to require the service provider to provide a warranty.
